נדחתה תובענה ייצוגית נגד ישראייר

בית משפט השלום בת"א דחה בקשה לאישור תובענה ייצוגית שהוגשה נגד חברת התעופה בטענה להפרת הוראות חוק שירותי תעופה בעקבות ביטול טיסה וחייב את המבקשת בהוצאות משפט

בית משפט השלום בת"א, השופט עדי הדר, דחה אתמול (ג') בקשה לאישור תובענה ייצוגית שהוגשה כנגד ישראייר בטענה להפרת הוראות חוק שירותי תעופה בעקבות ביטול טיסה של החברה.

ישראייר, באמצעות עוה"ד איתן ברוש ושרון פיאלקוב ממשרד ארנון, תדמור, לוי, טענה בין היתר כי יש לדחות את הבקשה, מאחר והיא לא ראויה להידון במסגרת הליך ייצוגי ומאחר ונפלו בה כשלים רבים.

עוד הוסיפו עוה"ד ברוש ופיאלקוב, כי "בנסיבות העניין ממילא מתקיים כלל יחוד העילה הקובע עי לא ניתן לתבוע מוביל אווירי שלא באמצעות חוק התובלה האווירית ו/או חוק שירותי תעופה וכי מכיוון שהטיסה נשוא בקשת האישור בוטלה כחמישה חודשים, טרם מועד ביצועה, הרי שבהתאם להוראות חוק שירותי תעופה, המבקשת וכך גם יתר חברי הקבוצה הנטענת אינם זכאים לפיצוי כלשהו".

בית המשפט, קיבל את טענות ישראייר במלואן, דחה את בקשת האישור וחייב את המבקשת בהוצאות בסך של 15,000 שקל.
