הישג: העליון דחה את בקשת המדינה לדחות את עתירת משרדי הנסיעות, מורי הדרך והמלונאים והורה על קיום דיון בהקדם

למרות עמדת המדינה: העליון יקיים דיון בהרכב של שלושה שופטים בעתירה נגד המדינה. כמו כן, לאחר שהמדינה טענה שהכנסת לא נכללה בעתירה ולכן יש לדחות אותה, העליון הורה על צירוף הכנסת כמשיבה בעתירות. הדיון יתקיים כבר בימים הקרובים

בית המשפט העליון לא קיבל את בקשת המדינה לדחות את בג"צ של התאחדות סוכני הנסיעות, מורשת דרך והתאחדות המלונות נגד ראש הממשלה, שר התיירות ושר הבריאות על סגירת השמיים. כמו כן דחה העליון את הנימוק של המדינה שהכנסת אינה צד בעתירה ולכן יש לדחות אותה. המדינה טענה כזכור בתשובתה לעתירה ביום חמישי כי בגלל שהכנסת לא צד לעתירה :"אין בפני בית המשפט את עמדתה של הכנסת בסוגיות המועלות בעתירות ואשר הכנסת הייתה צד להן. טעם זה יש בו, לשיטת המשיבים, כדי להצדיק את דחיית העתירות על הסף". שופט העליון ג'ורג' קרא, כתב היום (ראשון ) בהחלטתו כי: "אני מורה על צירוף הכנסת כמשיבה בעתירות. הכנסת תגיש תגובתה המקדמית 48 שעות לפני מועד הדיון בעתירות", ובכך נרשם הישג מבחינת סוכני הנסיעות, מורי הדרך והתאחדות המלונות. עוד קבע העליון כי העתירות תועברנה לדיון בבג"צ בהקדם האפשרי בהרכב של שלושה שופטים. את התאחדות משרדי הנסיעות ומורשת דרך מייצגים עוה״ד אסף פריאל, יובל בשן ונדב פיינמן ממשרד תדמור, לוי ושות׳. את התאחדות המלונות שכזכור הצטרפה אף היא לעתירה, ייצגו עוה״ד כפיר ידגר, נגה חרובי ואלונה בודינגר ממשרד גורניצקי ושות׳.
